GTO Shark Terms of Service

Important Notice: GTO Shark is an educational simulator and training tool. Gambling involves risk and may be illegal in some jurisdictions. Use the Services responsibly and in compliance with applicable laws.

1. Acceptance of These Terms

By accessing or using the GTO Shark website, simulators, software, and any related services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By using the Services, you represent and warrant that you meet this requirement and that you will comply with all applicable laws and regulations.

You may need an account to access certain features. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to notify us promptly of any unauthorized use or security breach.

4. Simulator / Educational Use Only (No Guarantee)

GTO Shark is purely a simulator and training tool designed to help users practice decision-making and understand concepts before entering a casino or gaming environment. The Services may include models, recommendations, probabilities, “optimal” lines, or strategy outputs; however:

• The Services are for informational and educational purposes only.
• We do not guarantee outcomes, profitability, winnings, or performance of any kind.
• Real-world results may differ due to variance, rule differences, game conditions, human error, dealer procedures, or other factors.

5. Responsible Use and Legal Compliance

You are solely responsible for how you use the Services and for ensuring your conduct complies with local laws. You agree not to use the Services:

• In any manner that violates applicable law or regulation;
• To exploit, cheat, or circumvent rules of any casino, platform, tournament, or venue;
• To engage in fraud, abuse, or other prohibited conduct.

6. Content and Intellectual Property

The Services, including software, text, graphics, UI/UX, algorithms, trademarks, and brand assets (including “GTO Shark”), are owned by GTO Shark or its licensors and are protected by intellectual property laws. Except as expressly allowed, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Services.

7. Purchases, Subscriptions, and Billing

Certain features may require payment (e.g., subscriptions or bundles). Prices, billing cycles, and included features may change. Unless otherwise stated, payments are charged in advance and are non-refundable except where required by law or expressly stated at purchase.

If you purchase through a third-party processor (e.g., Stripe or an app store), their terms may also apply. You are responsible for any taxes, fees, or charges imposed by your payment method or jurisdiction.

8. Disclaimers

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GTO SHARK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

AI Disclaimer: GTO Shark harnesses the power of artificial intelligence (AI) to provide its services. While we strive for accuracy and reliability, AI systems are subject to limitations and may make mistakes or produce inaccurate results. Users should exercise their own judgment and not rely solely on the outputs of the system.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components, or that any outputs will be accurate, complete, or suitable for your particular situation.

9. Limitation of Liability (Including Gambling Losses)

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER GTO SHARK NOR ITS AFFILIATES, OWNERS, EMPLOYEES, CONTRACTORS, LICENSORS, OR SUPPLIERS SHALL BE LIABLE FOR ANY LOSSES OR DAMAGES arising out of or related to your use of (or inability to use) the Services. This includes, without limitation:

• Monetary losses, gambling losses, lost profits, or lost expected winnings;
• Loss of data, loss of goodwill, business interruption, or reputational harm;
• Indirect, incidental, special, consequential, or punitive damages.

If liability cannot be excluded under applicable law, then to the maximum extent permitted, GTO Shark’s total aggregate liability for all claims shall not exceed the greater of (a) the amount you paid to GTO Shark for the Services in the three (3) months preceding the event giving rise to the claim, or (b) $100 USD.

You acknowledge and agree that gambling is inherently risky and that you assume full responsibility for any decisions you make and any outcomes, including any losses.

10. Indemnification

You agree to defend, indemnify, and hold harmless GTO Shark and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Services, your violation of these Terms, or your violation of any law or third-party rights.

11. Suspension and Termination

We may suspend or terminate your access to the Services at any time if we reasonably believe you violated these Terms, misused the Services, or created risk or legal exposure. You may stop using the Services at any time.

12. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date at the top indicates when changes were made. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

13. Governing Law
